Where this sector actually stands
No sector has been hit harder by the tightening of the Temporary Foreign Worker Program than food service. The core problem: most restaurant roles — cooks, servers, food counter attendants — pay below Ontario's high-wage threshold, which puts them in the Low Wage stream. And under the rules in force, ESDC refuses to even process Low Wage applications in metropolitan areas where unemployment is high — a bar Toronto has been over. Refused to process is not refused after review; the application is simply not accepted.
That is why the Low Wage numbers collapsed in our data, and why sales and service occupations fell by 68% across the GTA in a single year. Any consultant taking a fee to file a Low Wage LMIA for a Toronto restaurant right now should be asked to explain, in writing, how it will be processed.
None of this means a restaurant cannot hire. It means the realistic routes have changed — and they reward employers who plan instead of improvise.

Genuinely high-wage kitchen roles
An experienced chef or kitchen manager paid at or above Ontario's high-wage threshold is assessed under the High Wage stream, which is still processing. The wage has to be real and paid as advertised — this is not a labelling exercise.
Locations outside high-unemployment metro areas
The refusal-to-process rule is tied to the local unemployment rate. A location in a smaller Ontario market may be processable when your Toronto location is not. We check the current figures for your exact location on the call.
Hiring people already in Canada — no LMIA at all
PGWP holders, spouses on open work permits, and others with unrestricted status can be hired like any local worker. For most Toronto restaurants this is the fastest legal route to staff, and it costs nothing in government fees.

Paying for a 'guaranteed' LMIA
Charging a worker for a job offer or an LMIA is illegal, and schemes selling restaurant LMIAs are the most common immigration fraud in this sector. Employers who participate face bans from the program, fines and a public listing. If someone offers you money for a job offer, that is the moment to walk away.
Wages that differ from the application
The wage on the LMIA is a commitment, inspected against payroll. Tips cannot paper over a shortfall, and cash arrangements are exactly what inspections find. Underpaying against the application is treated as non-compliance, not a rounding error.
Advertising that misses the requirements
Job Bank posting rules — duration, content, where else you advertised — are checked to the letter, and advertising defects are among the most common reasons files fail. This part is entirely avoidable with planning.
Counting on rules that changed
Restaurant owners frequently arrive with advice from a friend whose cook got an LMIA years ago. The program that friend used effectively no longer exists in Toronto. Decisions based on the old rules cost real money.
